Terms & Conditions

These terms & conditions govern the relationship between:

Moor to Sea (Westcountry) Limited (registered number: 09352276)

62 Crediton Road

Devon EX20 1NU,

A company incorporated in England & Wales (“MTS” the “Company”, “we” or “us”) and “you” the customer.

These Terms and Conditions (the “Terms”) will form part of a Contract of Hire of a motor vehicle (“Rental Agreement”) between the hirer and the hire company.

Collecting the motor home.

Please try not to plan a major journey of your holiday on the same day you collect your vehicle.

We need to show you exactly how to get the most out of your motor home, and this will take some time.

It is essential that we give you a thorough introduction to the rental vehicle before the journey begins.

Oil, Water & Tyres

We check that these levels are at the correct level each time before our motor home goes out on hire.

We recommend that you check the oil, water and tyre pressures daily and you acknowledge and agree that doing so during the period of hire is your responsibility.

You also agree that you will be responsible for any damage, accident or breakdown resulting from your failure to keep the oil and water levels and tyre pressure at an appropriate level.

You agree that the cost of repairing or replacing the tyres of the vehicle during the rental period is your responsibility, unless the tyre is defective due to manufacture and is returned to us for inspection and replacement.

You agree to repay to us any and all costs incurred by us as a result of your failure to replace or repair the tyres.

If you have any questions about the state of the tyres on Collection, or during your hire, you should contact us immediately on (07481 813133).

We will provide the motor home to you in a clean and tidy condition.

We request that you return it to us in the same condition as when collected.

We provide you with cleaning equipment and materials free of charge so that you can do this.

If the vehicle is not returned to us in the same condition as when it was let out to you by us we reserve the right not to accept it’s condition. If we do not accept its condition, we will notify you at the time and we reserve the right to levy an additional valet charge of £75.

Replacement Vehicles.

If you have chosen a particular specification, size, model or make of motor home and it is not available, you agree that we may need to offer you another vehicle of a different specification, size model or make.

We will not charge you any additional hire charges in respect of a higher specification vehicle and if the vehicle is smaller or of a lower specification, we will refund you the difference between this vehicle and the one that you reserved.

If we do offer you a larger vehicle, we cannot be liable for any increase in road, ferry, toll, parking or other charges arising out of the difference in the vehicle sizes. You agree that you will not hold us responsible or seek to hold us responsible for any such charges.

If you are not sure whether there will be any higher charges as a result of the change, we suggest you contact the relevant service providers in advance of your journey.

European Travel.

You may ONLY travel to European countries outside of the UK by prior written agreement with us in advance of your departure from the UK and paid an additional insurance premium to cover your travel abroad. If you do not obtain our prior written permission to travel in our vehicle to a European country, you may not do so. A list of countries that are considered to be European for the purposes of our insurance and therefore the Rental Agreement is set out at the back of these Terms.

You may only travel to the countries set out in the Rental Agreement signed by you and us in respect of this hire.

Non-European Travel

You may ONLY travel to non-European countries by prior written agreement with us in advance of your departure from the UK.

Written confirmation from MTS and an additional insurance premium are required before beginning the journey.

You may not travel in the vehicle to any war or disaster zones. If you are not sure whether your intended destination is a war or disaster zone, please contact us.

NB: Please note that Turkey is currently not part of Europe.

Collection and Return

Your hire starts and finishes at our depot at [Holmans Wood, Harcombe Cross, Chudliegh, TQ13 0DZ]. For information on how to access the site, please ask at the time of booking.

We expect you to return the vehicle to us at the end of your hire in the same condition we gave it to you at the beginning of the hire.

Please allow one hour before the end of your hire period to return the vehicle, clean and unload it and complete the check in process. For example, if your vehicle is due back at 11.00a.m., please aim to be back at MTS at 10.00a.m. to complete the necessary steps.

Our trained staff will visually inspect the vehicle at the beginning and end of the hire for any obvious damage, as well as cleanliness, fuel and waste tank levels as well as the mileage recorded in the vehicle in your presence at the end of the hire.

Once you have departed, our trained staff will perform an in depth review of the vehicle and any additional damage or loss found during this inspection will be photographed in sequentially numbered and dated images taken of the damaged area and will be submitted to an independent repair contractor of our choosing for assessment. We shall also photograph the odometer as proof of the mileage at the time of return.

We reserve the right to charge the following levies:

For toilet tanks that are not empty:     £50

For a vehicle not in the same clean condition as on collection:  £75

Per hour (or part hour) for a late returned vehicle:  £50

You agree and acknowledge that we may undertake full or remedial repairs without referral to the hirer, and those costs, which you agree are reasonably incurred, will be charged to the hirer at least up to the value of the insurance excess lodged that you have paid to us.

Collection / Return Times

We have standard collection and return hours for our vehicles.

Collection times:

3 p.m. to 5 p.m.

Return times:

9 a.m. to 11 a.m.

If you would like to collect or return a vehicle outside of these hours, you must agree the time and date of the collection or return with us in writing in advance.

We will not be deemed to have received the vehicle until we have signed in acceptance of it. You will remain liable for the vehicle until we have signed our acceptance for it and any damage that occurs to the vehicle prior to our acceptance of it shall remain your responsibility in accordance with this agreement.

We carefully plan the times for delivery of our vehicles and so we request that you return the vehicle on time.

We reserve the right to charge a penalty of £50.00 per hour from the time your vehicle should have been returned to the time it is returned and we sign in acceptance of it. For the avoidance of doubt, we will charge fractions of the hour as a full hour.

If we become liable for any fees, costs, compensation or other expenses as a result of you returning the vehicle to us late, we reserve the right to pass these costs on to you in their entirety and you agree that you are liable for them.

Please return your vehicle on time.

Period of Hire

The times and dates of the contract of hire must be strictly adhered to. Unfortunately, we cannot offer a refund if you bring the vehicle back early and you acknowledge and agree that you will remain liable for the entire amount of the vehicle hire as agreed with you in advance of the hire.

You may register additional drivers of the vehicle with us, provided that:

They have a full, legal and valid UK driver’s license or equivalent, suitable for the vehicle type being hired,

They are listed as additional drivers in the insurance proposal form,

They meet the criteria listed below under ‘Driving Licences’, and

We have accepted them as drivers by countersigning the form and taking copies of the documents and details relevant to their addition to the insurance.

Driving Licences.

We have some specific rules about drivers’ licences and driver’s ages which are designed to protect you and us and which are imposed by our insurance company.

Drivers must be over 25 and under 75 years of age.

Drivers must have held a full driving licence for at least 2 years.

The licence must have no endorsements.

Licences with endorsements must be notified to our insurers and the endorsements must be produced before collecting the vehicle.

Current endorsements (those dated within 3 years) will incur an additional insurance charge.

Visitors from abroad must hold a current international driving permit or licence (Foreign license holders will incur an additional insurance premium charge).

2 forms of proof of address must be produced by all hirers at the start of the hire i.e. utility bills, bank statements or credit card statements.

A DVLA code will be required a few days before collection.

If your driver’s licence does not have your photo on it, we will also need to see a copy of your passport.

We cannot release the motorhome without these items being present and valid by the time of collection, failure to do so will result in forfeiture of the hire fee.

It is the hirer’s responsibility to ensure that all agreed drivers are licenced to drive the vehicle in line with our Term and Conditions.

We provide fully comprehensive motor insurance cover for the UK as standard. The following items are excluded from that cover and will be your responsibility during the rental period:

Damage to glass including windscreens and

Damage to tyres.

The vehicle is ONLY insured for the contracted period of the hire contracted. This means that late return of the vehicle will put you at risk of committing an offence under the Road Traffic Act 1988.

We advise you to take out additional personal holiday insurance to cover personal loss, illness, injury and holiday cancellation as these are not covered by the insurance provided with your rental.

We take an excess deposit by cash, credit or debit card pre-authorisation, bank transfer or cleared cheque in advance of the hire period as follows:

£1000 for ordinary hires,

£1250 if you are taking the vehicle to Glastonbury Festival,

£1500 at the discretion of our insurance company based on your circumstances,

A 2% surcharge will be made for any amounts charged to a credit card.

As long as you return the vehicle in the same condition that it was hired out to you, we will refund the deposit within 7 days of the end of the hire period.

If we have to make any claim against the insurance as a result of your hire, this will result in the full or partial loss of the excess deposit. Any charges we incur for loss or damage to the vehicle, its equipment or accessories which is not covered by the insurance policy, will be deducted from this deposit and/or billed at the time of return.

We also charge a £50 management fee, per incident, for the repair of any damage incurred to the vehicle during your hire and you are solely responsible for this fee. This fee covers the time and cost involved in taking the vehicle to be repaired, sourcing materials etc

If multiple instances of damage are sustained to the vehicle, our insurers reserve the right to treat each as a separate incident, and they may require a further insurance excess payment which we will charge you. You agree to indemnify us for any such charges incurred as a result of your hire and you acknowledge your responsibility for them and you agree to pay them promptly on demand.

You agree that you will advise us of any damage to the vehicle at the time it occurs (except for minor breakages and superficial damage such as scratches). You also agree that you will contact our insurance company using the details provided to you and complete the required paperwork such as claim forms or accident reports and any additional paperwork requested by the insurance company.

You agree to complete any such paperwork prior to leaving the vehicle on return at the MTS base. You agree to indemnify us for any costs or liabilities incurred as a result of your failure to do so.

The hirer (who is the insured person) hereby authorises Paul Stevens or Debbie Stevens jointly and severally or another representative of MTS to discuss, negotiate and action any insurance claims or matters directly with the insurance company on their behalf.

Insurance Excess Insurance.

Repairs to Motorhomes can be extremely expensive, even for damage that appears to be quite minor.

We strongly recommend you to take out a specific insurance policy to cover the insurance excess and any damage to glass & tyres as this is not covered by our insurance.

You should note that any such insurance must be in place prior to collection of the vehicle from us.

If any damage is sustained to the vehicle during the hire period, you will be responsible for payment of the excess damage costs out of your security deposit and you will also be liable for any additional costs over the top of that amount if:

you intentionally caused the damage,

you were driving under the influence of alcohol, drugs or other intoxicants,

you were driving without due care and attention,

you were driving off-road.

In those circumstances listed directly above, you will accept full responsibility for all damage and acknowledge that such damage may not be covered by our insurance and that you may be liable to account to us for the full amount of any repairs.

It is the hirer’s responsibility to recover any amount from any insurance company from whom additional insurance was purchased, and MTS will supply copies of documents required, including VAT invoices and 1 estimate for the repairs free of charge. Any unreasonable requests or requirement of a second estimate will incur an additional service charge.

If the vehicle is damaged by a third party we will treat the incident in exactly the same way as if it had been damaged by you.

Our web site contains links to an independent supplier of insurance that can cover damage to glass and tyres as well as the excess element of our main insurance policy. You acknowledge and agree that although we may act as the introducer for an insurance provider we are not their agent and do not represent that company. You should obtain your insurance directly from the insurance provider you select and make sure that you pay and keep up to date all relevant insurance premiums directly with them.

We may accept referral fees from these insurance providers for introducing them to you.

We may provide a suggested premium level over the phone but these are indicative and for your guidance only and should not be considered as a quotation. These indications are not an offer of insurance and the level of the premiums you are quoted by an insurance provider may vary significantly and we cannot be held responsible for any such variation.

You must obtain all quotes for insurance direct from an appropriate insurer.

1. We, MTS and our agents and assigns, are irrevocably authorized to complete any documentation and to take any other action to recover from your credit card issuer all amounts due by you pursuant to this Agreement during your hire, including but not limited to, any amounts due in respect to damage of the vehicle or to property of a third party and all other additional charges as they are incurred (including all parking and traffic infringement penalties, road toll fines, congestion and other municipal charges, and any associated administration costs) and to promptly pay on demand any amounts not charged during the period of your hire but arising and payable under this Agreement by you to us;

c) You acknowledge and agree that all credit and debit card transactions under this agreement are conducted in Pounds Sterling. Due to exchange rate fluctuations, there may be some variance between the amount initially debited against your credit card and the amount refunded within 7 days after the expiration of the rental period. You release MTS from any liability for such variation.

Cancellation Policy.

You may cancel your booking any time up to 43 days prior to the commencement of your vehicle hire. You will only forfeit the booking deposit of £200 per week of hire.

If we have already taken payment from you for the balance, we will refund the balance payment within 7 days of you notifying us of the cancellation in writing.

If you cancel your booking with 42 days or less to the commencement of your vehicle hire then you will be liable for 100% of the booking. If you have not already paid the balance of your booking fee, you agree that you will pay it to us. If you have authorised us to take payment from a card, we will take the balance payment from your card.

All cancellations must be made in writing. Any pre-paid insurance excess will be returned providing there are no outstanding monies due from your hire fees or your booking deposit.

We strongly recommend that you take out a suitable personal all risk holiday insurance cover (including cancellation) as any fees due for hires cancelled after the 42 day deadline will be payable and collected and will not be refunded under any circumstances.

Breakdown cover.

We provide the vehicle with UK breakdown cover for the period of your hire.

If you intend to use the vehicle abroad then you are required to pay for additional cover for the countries you intend to travel to. The cost of this cover will depend on the length of time the journey will take and the countries you intend to travel to.

In the unlikely event of a breakdown, MTS request that the hirer seeks the help of the appropriate breakdown company quoting the registration number of the vehicle.

You should not allow a breakdown team to perform any repairs without our PRIOR authorisation.

We will reimburse you for the costs of such a pre-authorised repair against a valid value added tax receipt.

You agree that any breakdown, malfunction or damage caused by your negligence will be made good at your expense.

Every effort is made to ensure the vehicle is in a roadworthy and safe condition prior to each and every hire.

We cannot accept any responsibility for hotel or any other consequential expenses subsequent to a breakdown.

We agree to refund the loss of any complete days of hire in which the vehicle was unusable providing the hirer has documentation to support this claim.

Suitable Persons.

We reserve the right to refuse the release of a vehicle at the commencement of a hire period for any reason whatsoever in our sole discretion, including but without limitation, if we consider you are not a suitable or responsible person to hire one of our vehicles for any reason whatsoever.

You are responsible for all costs and expenses incurred as a result of offences against the Road Traffic Act 1988, for any negligent act or omission, including without limitation filling the vehicles’ tanks with the wrong liquids or allowing frost and ice damage to occur to the vehicle or for any act of vandalism by you or your guests in the vehicle from time to time and you are also liable for any uninsurable damages including tyres, windscreen, and any internal damages or breakages.

You agree to indemnify and hold us harmless for any liability arising out of this. This means that you agree to be responsible for any costs (including legal costs) resulting from these offences and that you agree to pay us any amounts due as a result of this term.

Motorhome Systems.

MTS will carry out a full Pre Checkout Inspection (PCI) on every motorhome before the commencement of hire. The PCI involves testing every system on board the motorhome to ensure they are operating correctly. In conjunction with this the hirer will be taken on a tour of the motorhome and shown how each system works. Should an onboard system fail during your hire, MTS will make every effort to remedy the fault whilst you are away but in some circumstances this may not be possible and MTS cannot be held responsible and will not refund any monies should a loss of service be encountered nor have any obligation to provide a replacement vehicle. In the case of winter hire, MTS will not be and cannot be held responsible in the event of any damage or inconveniences caused by freezing conditions. This is the responsibility of the hirer.

Vehicle Security.

You are solely responsible for ensuring that the vehicle is securely locked at all times whilst the vehicle is left unattended.

You should conceal all valuable items from outside view and the TV/DVD should be stowed, covered or the blinds drawn.

If you fail to conceal all valuables while the vehicle is unattended you risk invalidating the insurance in the case of a break-in or theft. If that happens, you will be personally liable for any damage or loss caused to the vehicle during the break-in.

You acknowledge that all vehicles offered for hire may have had pets in them during previous hires.

You must obtain prior written approval from us to bring any pets with you.

If we approve your pet, you will be solely responsible for any damage whatsoever caused by the animal during the hire period.

You acknowledge that crates, cages and plastic beds are not allowed in the motorhome.

We will include pets, a maximum of 2 per hire if we approve them.

You may park one car free of charge at our depot at MTS during the period of you hire. All vehicles are left entirely at your risk and MTS accept no responsibility for any loss or damage which arises, whatsoever.

All of our vehicles run on diesel.

We supply the vehicle with a full tank of fuel and you agree to return it with a full tank of fuel.

If you do not return it with a full tank of fuel, we will charge you the cost of the refuelling the vehicle and a £20 administrative surcharge. We reserve the right to deduct this money from your security deposit or to charge it to your credit card without further reference to you. Our credit card payments terms shall apply to this payment if made by credit card, including the 2% surcharge.

You should not attempt to start the vehicle if you have put the wrong fuel type into the fuel tank.

If you do put petrol into the fuel tank instead of diesel, we will charge you the cost of removing the fuel from the tank as well as the cost of a new tank of fuel.

We do not offer refunds for the cost of the removed fuel.

If you attempt to start the vehicle with the wrong fuel in the tank, you will be responsible for all costs resulting from the mechanical damage to the vehicle and this may be substantial.

We supply you with 2 propane gas cylinders, one of which is full and one of which is partially used.

If you require more propane gas cylinders, you should purchase this at your own expense.

You acknowledge and agree that our vehicles are considered as public domain under the smoking ban set out by the Health Act 2006, which came into force on 1st July 2007.

You acknowledge and agree that it is illegal to smoke anywhere in the vehicle at any time.

If we suspect you have broken this rule, you are liable to forfeit your security deposit in its entirety. You may also become liable for fines from third party and government agencies charged with enforcing the smoking ban.

Lost Property

If you leave any property behind in the vehicle we will contact you to inform you that we have it. If you have not claimed it after 14 days from the time we contact you, we reserve the right to dispose of the property [by donating it to charity]. If you wish us to post the property to you, we will be happy to do so, but you will be responsible for all costs and charges relating to postage and these will be payable in advance of posting it.

We reserve the right to vary the rates and conditions of hire at any time and to decline hire to any person at any time without reason.

We reserve the right to change or substitute vehicles when necessary in accordance with the terms of this agreement.

Each provision of this agreement will be considered separate, and if a court of law should find any single provision or any part of a provision to be unenforceable, then that provision or part of that provision as applicable shall be read as if it were re-drafted with the unenforceable elements removed, or reduced to comply with the maximum of any threshold applicable by law.

Law and Jurisdiction.

These Terms shall be governed by and construed in accordance with the laws of England & Wales and any disputes will be decided exclusively by the courts of England & Wales.
